Return and Cancellation Policy

This policy regulates the conditions for withdrawing from a purchase and the procedures for returning commercial goods, in accordance with Government Emergency Ordinance 34/2014 on consumer rights.

1. Right of Withdrawal (Cancellation)

1.1. Cancellation before shipment: The Buyer has the right to request the cancellation of an Order at any time before receiving the shipping confirmation.

For Personalized Products, if the assembly process has been initiated, the order cancellation will be processed with the retention of a Disassembly Fee of 25 RON, representing compensation for the labor and logistical processing of unique components.

1.2. Exercising the right: The cancellation or return request must be submitted in writing, by completing the Return Form or via email at info@byfavia.ro.

2. Product Classification and Return Policy

2.1. Standard Products (Pre-built): Under applicable legislation, the Buyer (individual) has a 14-calendar-day period to withdraw from the contract without justifying the decision. The item must be returned in its original condition, without signs of use.

2.2. Personalized Products (Configured): In accordance with Art. 16 lit. c of Government Emergency Ordinance 34/2014, products made to the Buyer's specifications are exempt from the right of withdrawal. However, as a commercial exception, ByFavia accepts their return subject to the following compensatory conditions:

— Application of a Disassembly Fee of 25 RON, deducted from the refunded amount.

— Retention of shipping costs initially borne by the Company (if free shipping was offered).

3. Product Integrity Conditions

3.1. Returned products must be in the same condition as delivered: in the original packaging, accompanied by the authenticity certificate and without signs of wear, mechanical shock (chipped/scratched stones) or exposure to chemicals.

3.2. If the returned item shows damage that diminishes its value, the Company reserves the right to retain a portion of the product price to cover restoration costs (replacement of damaged stones/accessories), in addition to the disassembly fee.

4. Logistics and Shipping Costs

4.1. Cost responsibility: All direct costs related to returning products (courier fees) fall exclusively on the Buyer.

4.2. Shipping method: The return shall be made via express courier to the working address: Sat Cristian, Strada Nisipului 60 L, Brașov County.

4.3. Receipt refusal: The Company will refuse packages sent with "payment upon delivery" or requesting "cash on delivery" upon receipt, without prior written approval.

5. Refund Procedure

5.1. Legal deadline: The Company will refund the value of the goods within a maximum of 14 calendar days from the date of physical receipt and verification of the integrity of the returned products.

5.2. Payment channel: The refund is made exclusively by bank transfer to the IBAN account provided by the Buyer in the Return Form.

5.3. Amount calculation: The refunded amount will equal the product price, minus (as applicable): Disassembly fee (25 RON), initial shipping cost (if borne by the Seller), and any value diminution caused by improper handling.

6. Definitive Exceptions (Non-Returnable Products)

The following cannot be subject to return:

— Products showing clear signs of wear (scratches, deposits of cosmetic residues).

— Products returned without original packaging or without accompanying records (Certificate of Authenticity).

— Products returned after the expiration of the 14-calendar-day period from receipt.
