Terms and Conditions

1.1. These Terms and Conditions ("Terms") govern the legal relationship between: FAVIA GLOBAL TRADING S.R.L., a legal entity of Romanian nationality, with its registered office in Ilfov County, Snagov Village, Snagov Commune, 31 Nucului Street, registered at the Trade Registry under no. J2025063773009, CUI RO52380336, Share Capital 200 RON (referred to as the "Company" or "Seller"); and Individuals or legal entities using the website www.byfavia.ro ("the Site") or the services offered (referred to as the "User" or "Buyer").

1.2. Accessing the Site implies full acceptance of these Terms. If you do not agree, please cease using the Site.

1.3. The Site operates in Guest Checkout mode. The Company does not offer the option to create user accounts; order processing is done based on data provided individually for each transaction.

Configurator – The interactive module that allows product customization by selecting the type of stones, their order and dimensions.

Personalized Product – Any item made according to the Buyer's specifications through the Configurator.

Standard Product – A finished item, offered for sale without modification options.

Acceptance – Represents the moment when ByFavia validates the Order placed by the Buyer. For Personalized Products (configured), Acceptance coincides with the moment of online payment validation or, in the case of cash on delivery payment, with the confirmation that the product has entered the production/assembly process. From this moment, the remote sales contract is considered concluded, and the Buyer becomes responsible for the chosen specifications.

Confirmation – The electronic notification by which the Company confirms receipt of the order and the start of the production/dispatch process.

3.1. All content on the Site (images, texts, graphics, the logic of the Configurator algorithm) is the exclusive property of FAVIA GLOBAL TRADING S.R.L. and is protected by Law 8/1996 and Law 84/1998.

3.2. Data scraping, copying or using Site elements for commercial purposes without the written consent of the Company is strictly prohibited.

4.1. Users are responsible for the accuracy of data provided.

4.2. Where the Site allows the posting of reviews or comments, the following are prohibited: indecent language, insults, advertising messages (spam) or collection of data about other users. The Company reserves the right to delete any non-compliant content without prior notice.

5.1. Natural Variations: The Buyer accepts that semi-precious stones (agate, obsidian, etc.) exhibit natural variations in texture and color. These are not defects but attest to the authentic nature of the material.

5.2. Technical Errors: In the event of an order being registered at a derisory price or with obviously erroneous characteristics (due to human or technical causes), the Company reserves the right to cancel the order, returning the amounts paid, without further compensation.

5.3. The Company does not guarantee that the information on the Site meets all subjective requirements of visitors or that the use of stones will produce specific results (e.g., metaphysical properties).

6.1. Prices: All prices are expressed in RON and include VAT.

6.2. Payment methods: Online card (through an authorized processor Stripe) or Cash on Delivery.

6.3. Cash Limits: In accordance with Law 70/2015, cash payments are limited to 10,000 RON (individuals) and 5,000 RON (legal entities).

6.4. Transfer of Ownership: Ownership of goods transfers upon delivery, conditional on full payment.

7.1. Execution: Configured products are manually assembled within 1–2 working days.

7.2. Free Shipping: Applies to orders of at least 400 RON.

7.3. The Company ensures appropriate packaging and transmission of fiscal records.

7.4. Transfer of Risks and Contractual Liability: Transfer of the risk of loss or damage to goods occurs at the moment the Buyer, or a designated third party, takes physical possession of the products. Until effective receipt, the Company maintains patrimonial responsibility for the integrity of delivered goods. Once possession is taken, liability for the loss, degradation or damage of goods transfers entirely to the Buyer.

8.1. Standard Products (Pre-built): Under Government Emergency Ordinance 34/2014, individual Buyers have the right to return standard products within 14 calendar days of receipt, without justification. In this case, the refund will be made in full, but the return shipping cost falls exclusively on the Buyer.

8.2. Personalized Products (Configured) – Special Regime: Under Art. 16, lit. c of Government Emergency Ordinance 34/2014, products made to the Buyer's specifications are exempt from the right of withdrawal.

8.3. ByFavia Commercial Return Facility: Going beyond legal obligations, the Company offers Buyers the possibility to return or exchange even products made through the Configurator (Personalized), within 14 days, under the following strict conditions: a Disassembly Fee of 25 RON from the returned product's value; material integrity (no signs of wear); the Buyer bears all shipping costs (both ways).

8.4. Refund Procedure: (A) STANDARD products – the amount paid by the Buyer is refunded; return shipping cost remains the Buyer's responsibility. (B) CONFIGURED products – Refund amount = [Product Price] MINUS [Disassembly Fee 25 RON] MINUS [Initial Shipping Cost (outbound)]. (C) Deadline: maximum 14 calendar days from receipt and verification of returned materials, exclusively by bank transfer to the IBAN provided by the Buyer.

9.1. Compliance Warranty: 2 years (24 months) under Government Emergency Ordinance 140/2021, for the nature of stones and materials.

9.2. Commercial Warranty: 30 days for workmanship defects (knots, elastic).

9.3. Exclusions: Products worn under improper conditions (contact with perfume, chlorine, detergents), mechanical shocks (stone breakage from impact) or normal wear of metal plating are not covered by warranty.

10.1. These Terms and Conditions are subject to Romanian law.

10.2. Any dispute will be resolved amicably. Otherwise, jurisdiction lies with the courts at the Seller's registered office or through ODR mechanisms (Online Dispute Resolution).
